READ COMPLETELY BEFORE SIGNING
WAIVER AND RELEASE OF LIABILITY
On behalf of myself, my spouse (if any), heirs and personal representatives, upon signing this Waiver and Release, I agree that, if I engage in any physical exercise or activity conducted by SHORECORE LLC trading as COASTAL CORE FITNESS ( the “Club ”), use the Club facilities, or am present on the Club’s premises, I do so at my own risk and assume the risk of any and all personal injury, death, and/or damage to my property which I might sustain, regardless of whether such injury, death or damage arises out of or during physical exercise. My assumption of risk includes, but is not limited to, my use of any exercise equipment (mechanical or otherwise), the locker room, sidewalk, parking area, stairs, or any other part of, or item in or around, the Club facility. I recognize that physical exercise can be strenuous and subject me to serious injury or death. I represent to the Club that I have confirmed with my personal physician that I am healthy enough to participate in any exercise activity and to use the equipment at the Club. I assume the risk of my participation in any activity, class, program, instruction, or Club-sponsored event. I agree that I am voluntarily participating in the aforementioned activities and assume all risk, known and unknown, associated with using the Club facilities, equipment and premises including, without limitation, any loss or theft of any personal property. On behalf of myself and my spouse (if any), heirs and personal representatives, I forever release and discharge the Club and its owners, employees, instructors, agents, representatives, affiliates, successors and/or assigns from any and all claims or causes of action (known or unknown) arising out of the negligence of Club, whether active or passive, or that of any of its owners, employees, instructors, agents, representatives, affiliates, successors, and/or assigns. This waiver and release of liability includes, but is not limited to, injuries or death which may occur as a result of (a) my use of any exercise equipment or facilities which may malfunction or break, (b) the Club's improper maintenance of any exercise equipment or facilities, (c) the Club's negligent instruction or supervision and (d) my slipping and falling while in the Club facility or any portion of the premises for any reason, including Club's negligent inspection or maintenance of its facility or equipment. I further expressly agree that the foregoing Waiver and Release is intended to be as broad and inclusive as permitted by the law of the State of New Jersey and that, if any portion of this Waiver and Release is held invalid by a court of competent jurisdiction, the remaining terms shall continue in full legal force and effect. This Waiver and Release is not intended as an attempted release of claims of gross negligence or willful misconduct. The Club is not in the business of selling, leasing or otherwise placing into the stream of commerce exercise equipment, or other such products, and the use of any such items is incidental to the service provided by the Club.
I hereby release and agree to hold ShoreCore, LLC its owners, employees and instructors (the “ ShoreCore Persons”) harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of ShoreCore LLC, and the ShoreCore Persons, or that may otherwise arise in any way in connection with any services received from ShoreCore, LLC and the ShoreCore Persons. I understand that this release discharges ShoreCore, LLC and the ShoreCore Persons from any liability or claim that I, my heirs, or any personal representatives may have against the ShoreCore, LLC and the ShoreCore Persons with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from ShoreCore, LLC and the ShoreCore Persons.
I ACKNOWLEDGE THAT I HAVE HAD SUFFICIENT OPPORTUNITY TO CAREFULLY READ THIS WAIVER AND RELEASE AND THAT I FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY AND AN EXPRESS ASSUMPTION OF RISK. I AM AWARE AND AGREE THAT BY EXECUTING THIS WAIVER AND RELEASE, I AM GIVING UP MY RIGHT AND THE RIGHTS OF MY SPOUSE, HEIRS AND PERSONAL REPRESENTATIVES TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST THE CLUB, ITS OWNERS, EMPLOYEES, INSTRUCTORS, AGENTS, REPRESENTATIVES, AFFILIATES, SUCCESSORS AND/OR ASSIGNS FOR ITS OR THEIR NEGLIGENCE, OR FOR ANY DEFECTIVE PRODUCT OR EQUIPMENT ON THE CLUB’S PREMISES. I HAVE READ AND VOLUNTARILY SIGNED THIS WAIVER AND RELEASE AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS HAVE BEEN MADE TO ME TO PERSUADE ME TO SIGN THIS WAIVER AND RELEASE. I AGREE, FOR MYSELF AND MY SPOUSE, HEIRS AND PERSONAL REPRESENTATIVES, THAT THE ABOVE REPRESENTATIONS ARE CONTRACTUALLY BINDING AND ARE NOT MERE RECITALS.
FURTHER, I ACKNOWLEDGE AND ACCEPT THE FOLLOWING LATE CANCELLATION AND NO SHOW POLICIES. All group classes require an 8-hour cancellation notice. Unlimited memberships will be charged $20 for a late cancel and $25 for a no-show if a class is not canceled in advance of the noted cancellation period. Group packages will forfeit their class if a class is not canceled in advance of the noted cancellation period. Classes cannot be rescheduled for a different class time past the 8-hour window. Private sessions require a 24-hour cancellation notice, and will be held accountable for 50% of the private session fee for a no show. Please make sure to arrive AT LEAST 5 minutes prior to class time to ensure your spot isn't given to a standby student.
All members must agree to the cancellation policy in order to use Coastal Core Fitness. There will be no exceptions.
